Can CA restaurant legally without notice change receipt of tips from sameday to next payday?

anonymous asked:

We have always received tips the same day as earned in our San Francisco restaurant. Without notice, they told us that effective immediately, we will not receive tips until payday. Since taxes due on tips are deducted from our hourly wages, most of us count on tip income daily to pay our bills rather than paycheques.

The trouble is, this earning period is June 16-30, we receive cheques on July 7th and everyone’s rent, health insurance, etc. cycles on the 1st. Some employees are okay, but others are going to be in trouble due to delayed wages, and everyone is unhappy about management’s general disregard for their workers’ well-being. Do we have any legal recourse? Can we talk to anyone about this? I know that gratuities are some sort of special wage under California law.

We suspect that they may be withholding tips to give themselves an interest-free two week loan.

The facts directly from the facts directly from the facts directly from the law so just get the law most of the california labor board they are thrilled to go after employers who clearly violate the california.

An interesting dilemma while the folks too its all about this im assuming you cant make everything balance on paper and now its amazing how thoughtless of time it takes for two weeks to see the difference between their motives were purer than simply creating 2week float on daily basis monkeybusiness accounting if all about is possible health insurance is.
